ALPHARETTA, Ga. (BFMG) — Kroy “KJ” Biermann Jr. has been charged as an adult with felony aggravated sodomy and felony aggravated sexual battery in connection with an alleged sexual assault at an Alpharetta fitness center.
According to arrest warrants filed in Fulton County Magistrate Court, Biermann Jr. was arrested Monday, Aug. 17.
The Alpharetta Police Department (APD) said the charges stem from an incident reported April 23 at the Life Time Fitness on North Point Parkway.
Investigators said Biermann Jr. met a 15-year-old acquaintance in the facility’s cafe before leading her into the family changing area. The alleged victim told police that Biermann Jr. restrained her, made unwanted sexual contact and forced her to engage in sexual acts against her will.
The teenager was later examined by a sexual assault nurse examiner at Children’s Healthcare of Atlanta (CHOA), where a sexual assault kit was completed.
According to the arrest warrant, testing performed on the alleged victim did not identify male DNA.
Biermann Jr. is the son of Kim Zolciak and former NFL player Kroy Biermann Sr., both of whom appeared on reality television.
Zolciak Defends Son
In a statement published by TMZ, Zolciak said her son denies the allegations.
“The allegations being made against my son are nothing short of reckless and deeply troubling,” Zolciak said. “He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.”
Zolciak also said Biermann Jr. voluntarily took and passed a polygraph examination related to the allegations.
Neither Biermann Jr. nor his defense attorney has publicly commented on the charges. It was not immediately clear whether Biermann Sr. has addressed the case publicly.
What’s Next
A Fulton County Superior Court judge is expected to oversee pretrial proceedings in September.
It remains unclear whether prosecutors could pursue additional charges.
Biermann Jr. is presumed innocent unless and until proven guilty in court.
